Orari Irrigation – Equipment Hire Terms & Conditions (NZ)

These Terms apply to all equipment hire transactions with Orari Irrigation (“we”, “us”, “our”). By booking, collecting, or using hired equipment, you (“you”, “Hirer”, “Customer”) agree to these Terms.

If there is any conflict between these Terms and a specific written hire schedule/quote/invoice, the hire schedule/quote/invoice will prevail to the extent of the inconsistency.

1) Definitions

  • Equipment: Any equipment, tools, accessories, hoses, fittings, cables, trailers, PPE, consumables (if supplied), and any replacements provided during the hire.

  • Hire Period: From the time Equipment is collected/delivered to you until it is returned and checked back in by us (or collected by us).

  • Consumer Customer: Hiring primarily for personal, domestic, or household use.

  • Trade Customer: Hiring for business purposes (including farming operations, contracting, commercial use).

2) Bookings and eligibility

2.1 Minimum requirements: You must be at least 18 years old and provide acceptable ID and contact details.
2.2 Booking confirmation: Bookings are confirmed when we accept them (e.g., written confirmation, invoice, or collection/delivery).
2.3 Right to refuse: We may refuse hire (including collection/delivery) where we reasonably consider the hire unsafe, unlawful, or where payment/ID requirements are not met.

3) Hire charges, bonds, and payment

3.1 Charges: Hire charges are calculated per the rates shown on our website/quote at the time of booking, plus any delivery, cleaning, damage, consumables, or other fees.
3.2 Bond/security deposit: We may require a bond/security deposit. The bond may be used to cover unpaid charges, damage, cleaning, loss, late return fees, or other amounts owing. Any balance will be refunded after return inspection.
3.3 Payment timing: Unless agreed otherwise, hire charges and bonds are payable before collection/delivery.
3.4 Overdue amounts: Overdue amounts may incur reasonable recovery costs and interest (to the extent permitted by law).

4) Collection, delivery, and return

4.1 Collection: You must check Equipment at collection. If you sign/accept collection, you confirm it is received in apparent good condition (fair wear and tear excepted).
4.2 Delivery: If we deliver, delivery occurs when Equipment is made available at the delivery location; you must inspect promptly.
4.3 Return condition: Equipment must be returned:

  • on time,

  • to the agreed location,

  • clean and in the same condition as supplied (fair wear and tear excepted),

  • with all accessories provided.
    4.4 Late returns: Late returns may incur additional hire charges (often charged in half or full day blocks) and may affect availability for other customers.
    4.5 Unreturned Equipment: If Equipment is not returned when due, we may treat it as lost and charge replacement cost plus any outstanding hire charges and fees.

5) Risk, security, and responsibility

5.1 Risk: You are responsible for the Equipment from the time it is collected/delivered until it is returned and checked in (or collected by us).
5.2 Security: You must keep Equipment secure and protected from weather, theft, and misuse (e.g., locked storage when not in use).
5.3 No sub-hire: You must not sub-hire, lend, sell, or otherwise dispose of the Equipment.

6) Use of Equipment and safety

6.1 Proper use: You must use Equipment only:

  • for its intended purpose,

  • in accordance with any instructions/manuals/safety guidance,

  • by competent persons (and licensed operators where required).

6.2 Prohibited use: You must not use Equipment:

  • illegally,

  • in a manner that voids manufacturer guidance,

  • while impaired (alcohol/drugs),

  • in unsafe conditions or contrary to site safety rules.

6.3 Health & Safety: You are responsible for safe operation at your site, including appropriate PPE and exclusion zones. We will supply Equipment in a condition we reasonably believe is safe and fit for hire, and we may provide safety information.
6.4 Faults must be reported: Stop using the Equipment immediately if it becomes unsafe, malfunctions, or is damaged, and notify us.

7) Breakdown, servicing, and replacement

7.1 Fair breakdown: If Equipment breaks down due to fair wear and tear during normal use, contact us. We may (at our option) repair, replace, or terminate the hire.
7.2 No repairs without permission: You must not repair or modify Equipment without our approval.
7.3 Call-out costs: If a fault is caused by misuse, overloading, incorrect setup, contamination, or lack of care, you will be responsible for repair and call-out costs.

8) Damage, loss, and theft

8.1 Your liability: You are responsible for loss, theft, or damage (including corrosion, contamination, water ingress, motor seizure, electrical damage from incorrect supply, etc.) occurring during the Hire Period, except to the extent caused by our negligence or where the law doesn’t allow us to charge you.

8.2 Costs: If Equipment is damaged, you must pay the reasonable cost of repair. If it is lost/stolen or uneconomic to repair, you must pay replacement cost (including freight and any accessories).
8.3 Theft: Theft must be reported to Police and to us as soon as practicable, and you must provide a Police event number.

9) Insurance

9.1 Your insurance: You are responsible for arranging any insurance you consider necessary (including theft, damage, public liability).
9.2 Our insurance: Any insurance we hold is not for your benefit unless we expressly confirm in writing.

10) Liability

10.1 Consumer Customers: Nothing in these Terms limits any rights or remedies you may have under the Consumer Guarantees Act 1993 or other consumer protection laws where applicable.
10.2 Trade Customers: To the maximum extent permitted by law, and subject to clause 11 (CGA contracting out), we exclude liability for indirect or consequential loss (e.g., loss of profit, downtime, crop loss) arising from the hire or use of the Equipment.
10.3 General: To the maximum extent permitted by law, our total liability arising from any hire is limited to the hire fees paid for the relevant hire (or, at our option, replacement/repair of the Equipment).
10.4 No misleading statements about rights: We do not intend these Terms to mislead you about your legal rights (Fair Trading Act).

11) Consumer Guarantees Act – contracting out (Trade Customers only)

11.1 Trade Customer acknowledgement: If you are hiring for business purposes, you agree that:

  • the hire is in trade, and

  • the parties contract out of the Consumer Guarantees Act 1993 to the maximum extent permitted.

11.2 This clause does not apply to Consumer Customers.

12) Cancellation and no-shows

12.1 Cancellation: You may cancel before collection/delivery by contacting us. We may charge a reasonable cancellation fee if we have already incurred costs (e.g., transport scheduling).
12.2 No-show: If you do not collect/accept delivery at the agreed time, we may cancel the booking and charge reasonable costs incurred.

13) Website info and availability

13.1 Equipment images/specs on our website are indicative only. Availability is not guaranteed until confirmed.
13.2 We will take reasonable care that descriptions and pricing are accurate (Fair Trading Act).

14) Privacy

14.1 We collect and use personal information to process bookings, verify identity, manage payments, and recover Equipment/amounts owing.
14.2 We store and handle personal information in accordance with the Privacy Act 2020 and NZ

privacy principles.
14.3 You can request access/correction of your personal information by contacting us at: admin@orariirrigation.co.nz.

15) PPSA

15.1 You acknowledge that the Equipment is and remains our property at all times.
15.2 Where relevant (for example, longer-term hires that may be treated as a lease), we may take steps to protect our interest under the Personal Property Securities Act 1999, including registration on the PPSR.

16) General

16.1 Governing law: These Terms are governed by the laws of New Zealand and disputes are subject to NZ courts/tribunals.
16.2 Severability: If any part of these Terms is unenforceable, the rest remains in force.
16.3 Changes: We may update these Terms from time to time by publishing the latest version on our website (updates apply to new hires after publication).
